Proposed Committee Amendment to LD 9

An Act to Prohibit the Creation of a Firearms Owner Registry

Sec. 1.  25 MRSA §2014  is enacted to read:

§ 2014. Government firearm or firearm owner registry prohibited

A government agency of this State or a political subdivision of this State may not keep or cause to be kept any list or registry of privately owned firearms or any list or registry of the owners of those firearms. The provisions of this section do not apply to:

1.  Firearms used in committing a crime.  Firearms that have been used in committing a crime and retained in the investigation and prosecution of that crime; or

2.   Protection from abuse orders pursuant to Title 19-A, section 4006, subsection 2-A.   To a list maintained by a court or law enforcement agency pursuant to Title 19-A, section 4006, subsection 2-A. 

SUMMARY

This bill prohibits a government agency of this State or a political subdivision of this State from keeping a list or registry of privately owned firearms or a list or registry of the owners of those firearms and provides 2 exceptions.  This amendment deletes the exception for a firearm used in committing a crime of violence dangerous to human life and the exception for a gun owner who has been convicted of a crime of violence dangerous to human life.  The amendment adds exceptions for a firearm used in committing a crime and retained in the investigation and prosecution of that crime and for a list maintained by a court or law enforcement agency in connection with a protection from abuse action pursuant to Title 19-A, section 4006, subsection 20-A.
